Gregory Bethke appeals a judgment dismissing his complaint against Lauderdale North Association, Inc., for damages incurred when he was injured on the grounds of the Lauderdale North condominium complex. Bethke contends that the circuit court erred when it concluded that the association was a nonprofit organization immune from liability under Wisconsins recreational immunity statute, Wis. Stat. Â§ 895.52 (1997-98). He also contends that the immunity statute, as applied on the present facts, violates the equal protection clauses of the United States and Wisconsin Constitutions, and that the association should, like a "private" property owner, lose its immunity because it collects money for the use of the property in question.
